This change order will modify the footings for traffic signal locations I and J. The footings will be a pad footing measuring 6 by 6 feet for location I and a pad footing measuring 7 by 7 feet for location J. This change order will modify the block wall to provide a minimum of 48" of space and replacement of sidewalk. CONTRACT ADJUSTMENT: As a result of this change order the contract price is adjusted as follows: 1. The contract price is increased in the amount of $7,999.28, from the current contract price of $130,160.00 to a new contract price of $138,159.28. Page 1 CONTRACT CHANGE ORDER NO. 2 2. The contract time is increased by Ten (10) working days. A Notice to Proceed was given previously on Monday November 8, 2004, to do out of sequence work such as installation of conduit for traffic loops prior to installation of street and sidewalks by others. The time utilized was 10 working days. The remaining working days, including the increase in time is now Thirty (30) working days. This change order shall be considered full compensation for furnishing and installing the materials, labor, tools and equipment, profit, overhead, and all incidentals for performing the work described above. HMS Construction, Inc. will not be entitled to damages or additional payment for delays as described in the 1997 edition of the Standard Specifications for Public Works Construction, Section 6-6.3, for performing the work as described above. HMS2 A-200 (Rev. 7/03) RE: Resolution of the City of National City approving Change Order Number Two to HMS Construction, Inc. for Sweetwater Rd. at Calmoor St. and Fairlomas Drive Traffic Signal Installation, Spec. No. 03-10, in the amount of $7,999.28 for modification of foundation due to existing storm water pipes encountered under sidewalk and authorizing the City Engineer to approve and sign the change order. Explanation: On August 3, 2004, by resolution No. 2004-141, the City Council awarded a contract in the amount of $125,190 to HMS Construction, Inc. for the Sweetwater Rd. at Calmoor St. and Fairlomas Drive Traffic Signal Installation, Specification No. 03-10. During excavation for the footings of traffic signal locations I and J, three storm drain pipes 66 inches in diameter were encountered at a depth of 6 feet 2 inches. The standard footing depth for each traffic signal is 8 feet. Engineering staff is recommending the approval of a change order to HMS Construction, Inc. in the amount of $7,999.28 for the modification of the standard footings to a 6 by 6 foot pad footing for traffic signal I and a 7 by 7 foot pad footing for traffic signal J per structural calculations provided by Tetra Tech, Inc. the engineering consultant. The total amount of Contract Change Order Number Two is $7,999.28, increasing the current cost of the project from $130,160 to $138,159.28, which is below the total estimated budget for the project of $156,487.50. RESOLUTION NO. 2005 — RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO EXECUTE CHANGE ORDER NO. TWO WITH HMS CONSTRUCTION, INC. IN THE AMOUNT OF $7,999.28 FOR MODIFICATION OF THE FOUNDATION DUE TO EXISTING STORM WATER PIPES ENCOUNTERED UNDER SIDEWALK FOR THE SWEETWATER ROAD AT THE CALMOOR STREET AND FAIRLOMAS DRIVE TRAFFIC SIGNAL IMPROVEMENT PROJECT WHEREAS, the contract for the Sweetwater Road at Calmoor Street and Fairlomas Drive Traffic Signal Improvement Project was awarded to HMS Construction, Inc. on August 3, 2004, by the adoption of Resolution No. 2004-141; and WHEREAS, during excavation for the footings of traffic signal locations I and J, three storm drain pipes sixty-six inches (66") in diameter were encountered at a depth of six feet two inches (6'2"). The standard footing depth for each traffic signal is eight feet (8'); and WHEREAS, due to the storm drain pipes, modification of the standard footings to a six-foot by six-foot (6' x 6') pad footing for traffic signal I, and a seven -foot by seven -foot (7' x 7') pad footing for traffic signal J is required. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby authorizes the City Engineer to execute Change Order No. 2 with HMS Construction, Inc. in the amount of $7,999.28 for the modification of the standard footings to a six-foot by six-foot (6' x 6') pad footing for traffic signal I, and a seven -foot by seven -foot (7' x 7') pad footing for traffic signal J at the Sweetwater Road at Calmoor Street and Fairlomas Drive Traffic Signal Improvement Project.
