RECITALS A. The CITY and the CONTRACTOR entered into an Agreement on July 27, 1999, (the "Agreement") providing that the CONTRACTOR would prepare the Paradise Creek Educational Park Enhancement Plan. B. Said Agreement was subsequently amended on December 12, 2000; October 16, 2001; August 20, 2002; October 15, 2002; March 18, 2003; and October 7, 2003. C. The CITY and the CONTRACTOR wish to amend the Agreement again by amending the Scope of Services thereof. NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS: 1. That the Agreement between the CITY OF NATIONAL CITY and SCHMIDT DESIGN GROUP dated July 27, 1999, and amended on December 12, 2000; October 16, 2001; August 20, 2002; October 15, 2002; March 18, 2003; and October 7, 2003, is hereby amended by amending the Scope of Services thereof, as set forth in the attached Exhibit "A", attached hereto and incorporated herein by reference. 2. With the foregoing exception, each and every term and provision of the Agreement dated July 27, 1999, shall remain in full force and effect. Eiser, III City Attorney Item Title: Resolution of the City Council of the City of National City Authorizing the Mayor to Execute an Amendment to the Current Agreement with Schmidt Design Group to Provide Additional Services Required to Finalize Construction Documents for the Paradise Creek Educational Park Explanation: On July 27, 1999 per Resolution No. 99-105, City Council approved an agreement between the City of National City and Schmidt Design Group. The agreement was for the preparation of the Paradise Creek Educational Park enhancement plan. Schmidt Design Group was selected following the City's standard consultant selection proceedings. Funding for the contract ($49,140) was obtained from a $50,000 grant from the Califomia State Coastal Conservancy specifically earmarked for this purpose. The enhancement plan was completed and on June 27, 2001, The State Coastal Conversancy awarded the City a $700,000 grant for its implementation. On December 2, 2002, the Conservancy increased the grant to -$710,000. The City Council in anticipation of the June 27, 2001 State Coastal Conservancy grant approval amended the contract with Schmidt Design Group on December 12, 2000. The contract was for the preparation of construction plans and specifications and the fee was not to exceed $96,115. Since then there have been five amendments to the contract, both decreasing and increasing the scope of work (and the fee). In addition, the Consultant will assist staff in the preparation of grant applications and update plans as necessary through the construction period. Most of this work (see Exhibit "Al will be on a time and material basis and is expected not to exceed $5,500. The amendment therefore, will increase the contract to $138,190. It should be noted that the project is currently out to bid with the bid opening scheduled for June 15, 2005.
