This increase in contract price is due to compliance of State law from the Energy
Commission efficiency standards that prohibits the sale of traffic signal lamps
manufactured on or before March 1, 2003 and consume more than the specified amounts
of power. The only technology that is currently capable of meeting those requirements is
LED equipment. Compared to incandescent equipment, typical LED equipment reduces
electricity use by 80-90 percent.
This change order will substitute incandescent yellow traffic signal lamps for LED lamps
to comply with state law.
CONTRACT ADJUSTMENT:
As a result of this change order the contract price is adjusted as follows:

1. The contract price is increased in the amount of S2,421.66, from the current
contract price of $138,159.28 to a new contract price of $140,580.94.
The contract time is increased by five 5) working days. A Notice to Proceed was
given previously on Monday November 8, 2004, to do out of sequence work such
as installation of conduit for traffic loops prior to installation of street and
sidewalks by others. l'he time utilized was 10 working days. The contract
completion date was previously established as Monday July 25, 2005. The new
contract completion date is therefore established as Monday Augustl, 2005.
This change order shall be considered full compensation for furnishing and installing the
materials, labor, tools and equipment, profit, overhead, and all incidentals for performing
the work described above. IIMS Construction, Inc. will not be entitled to damages or
additional payment for delays as described in the 1997 edition of the Standard
Specifications for Public Works Construction, Section 6-6.3, for performing the work as
described above.

California Law on. the Sale of Traffic Slenals
As a result of corrimunications between employees of the Califomia:Energy Commission and
employees doilies and counties throughout California, it appears that there may be some
confusion about California law that affects the sale, by your company and others, of traffic
signal modules and lamps in the state. This letter provides clarification.
In Felaniary 2002, the Energy Commission adopted new energy efficiency standards for traffic
sigraat modifies anii'trafiio signaLlamps. This does not include pedestrian'signals; (The
Ehergy Commission also:adbpts and enforces etficiericy standards for many: other appliances,
such as refrigerators, air c0.nddioners, and Water heaters.) The traffic signal standards are
found in Section 1605.3(m) of Title 20 of.the California Code of Regulations. a copy of which is
attached to•this letter. The standards require that any Oa* Signal modules -or trafic skanal
lamps, whichare manufactured. on or after March 1, 2003, and are sold or Offered for sale in
California, must consume no more than specified amounts of power. The only technology -that
is currently capable of meeting those requirements is right -emitting diode (LED) equipment.
Coinpared to irxandescent equipment, typical LED equipment reduces electricity use by 80-90
percent.
California law says that it is illegal to self in the state, oreven to offer for sale in the state, any
appliance that does not comply with the Energy Commissions efficiency standards. (Calfomia
Public Resources Code section 25402(c)(:1),). This means that it would be illegal if your
company sold, or offered for sale, in California, war noncomplying traffic signal or module that
was manufactured on or after March 1, 2003. (The law on the location of an "offeror a "sale'
is complex, especially for catalog, telephone, fax, or Internet sales. Sometimes what may
appear to be an out-of-state sale. is legally regarded as obcurring in the state. Whether any
particular offer or sale occurs in:the state, or outside, depends on the facts and circurflstances
of the individual case.)
Violations of the.'Energy Commission's standards are referred to the California Attorney
General, who seeks injunctive relief against violators. (California Public Resources Code
section 25900.)

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
AUTHORIZING THE CITY ENGINEER TO EXECUTE
CHANGE ORDER NO. THREE WITH HMS CONSTRUCTION, INC.
FOR THE SWEETWATER ROAD AT THE CALMOOR STREET
AND FAIRLOMAS DRIVE TRAFFIC SIGNAL IMPROVEMENT PROJECT IN
THE AMOUNT OF $2,421.66 FOR COMPLIANCE WITH STATE ENERGY
COMMISSION EFFICIENCY STANDARDS FOR TRAFFIC SIGNAL LIGHTS
(Engineering Spec. No. 03-10)
WHEREAS, the contract for the Sweetwater Road at Calmoor Street and
Fairtomes Drive Traffic Signal Improvement Project was awarded to HMS Construction,
Inc. on August 3, 2004, by the adoption of Resolution No. 2004-141; and
WHEREAS, California law requires that appliances for traffic signal
modules or lamps manufactured on or after March 1, 2003, comply with the Energy
Commission's efficiency standards; and
WHEREAS, the 16 yellow traffic signal incandescent lamps planned for
this project must be substituted with LED equipment to comply with state law.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of National City hereby authorizes the City Engineer to execute Change Order No. 3
with HMS Construction, Inc. in the amount of $2,421.66 to substitute the incandescent
lamps for the 16 yellow traffic signal lamps with LED equipment to comply with state law
at the Sweetwater Road at Calmoor Street and Fairlomas Drive Traffic Signal
Improvement Project.
PASSED and ADOPTED this 2nd day of August, 2005.
