RECITALS WHEREAS, National City Fire Department submitted a grant funding proposal for a FY 2005/2006 Motorist Aid and Safety Project (the Project); and WHEREAS, the SAFE Board of Directors approved the Project for funding at its May 12th, 2005 meeting; NOW, THEREFORE, in consideration of the mutual covenants, terms and conditions contained herein, the parties agree as follows: 1. A copy of National City Fire Department's proposal is attached hereto and incorporated by reference as Appendix "A". 2. SAFE will provide grant funding for actual costs for goods, labor and/or services stated in National City Fire Department's proposal in an amount not to exceed $15,000. SAFE will provide said funding when funds become available after July 1, 2005 upon presentation by National City Fire Department of either a Purchase Order or Vendor Invoice approved by the National City Fire Department's Project Officer. Grant funds may only be used for legitimate Project expenses as delineated in the proposal. 3. Documents may be sent or delivered to SAFE at the following address: San Diego Service Authority for Freeway Emergencies C/o TeleTran Tek Services ATTN: Edward Steven Castoria, SAFE Executive Director 9167 Chesapeake Drive San Diego, California 92123 4. SAFE is serving solely as a funding source for the Project. Provision of that funding does not in any way obligate SAFE to provide any further funding for the project, nor does it make SAFE in any way responsible for National City Fire Department's use of the goods, labor and/or services provided to National City Fire Department under this grant funding. 5. SAFE, TeleTran Tek Services, and the County of San Diego shall not be liable for, and National City Fire Department shall defend, indemnify and hold them and each of them harmless from, any and all claims, demands, liability, judgments, awards, fines, mechanics' liens or other liens, labor disputes, losses, damages, expenses, charges or costs of any kind or character, including attorneys' fees and court costs (hereinafter collectively referred to as "Claims"), related to the work covered by this agreement arising either directly or indirectly from any act, error, omission or negligence of National City Fire Department or its contractors, licensees, agents, servants or employees, including, without limitation, Claims caused by the concurrent negligent act, error or omission, whether active or passive, of SAFE, TeleTran Tek Services, or the County of San Diego, or their agents or employees. However, National City Fire Department shall have no obligation to defend or indemnify SAFE, TeleTran Tek Services, or the County of San Diego from a Claim if it is determined by a court of competent jurisdiction that such Claim was caused by the sole negligence or willful misconduct of SAFE, TeleTran Tek Services, or the County of San Diego or their agents or employees. PROBLEM STATEMENT: The National City Fire Department (NCFD) is seeking assistance to purchase Hazardous Materials Response Kits and Rapid Response Kits totaling $15,000. The program will deliver personnel and rescue equipment to reduce the loss of life at all vehicle accidents and hazardous materials releases on our freeways. With the new rescue equipment, we feel we can make a big impact on citizens of all ages traveling throughout South San Diego County. We will also improve the rescue delivery system in National City and neighboring jurisdictions. National City is a coastal city located immediately south of San Diego and ten miles north of the United States/Mexico border. The city covers 8.5 square miles and has approximately 59,000 residents. Three high traffic freeways intersect National City: San Diego Freeway (I-5), South Bay Parkway (S-54), and the Jacob Dekema Freeway (I-805). As a result of its proximity to these major freeways, there is a substantial amount of day and nighttime traffic that passes through National City. The NCII) responds into the cities of San Diego on the north and east, Chula Vista to the south, and Bonita and Spring Valley to the southeast. With "Automatic Aid" agreements in place with all these agencies, the NCFD has responded innumerable times over the years with all of these agencies. Our problem is that a large underage population mixes drinking and driving by going to Tijuana, Mexico, where the legal drinking age is 18. Young men and women partygoers regularly travel to Tijuana for a night out and then attempt to drive back to their homes in San Diego County. Since National City is only 10 miles from Tijuana, many vehicle accidents due to driving under the influence of alcohol occur on our freeways. Collision Type /Year 1998 1999 2000 Fatal Injury Fatal Injury Fatal Injury National City 1 307 3 367 8 348 Collision Data 1998-2000 (Source: California Highway Patrol Statewide Integrated Traffic Records System) Although the National City Police Department continues to take an aggressive posture to prevent and deter drinking and driving (particularly through the widespread use of sobriety checkpoints and saturation patrols) in National City, it has no control over enforcement on our freeways. This responsibility falls on the California Highway Patrol. As a result of not being able to prevent/deter 1 Appendix "A" SAN DIEGO SERVICE AUTHORITY FOR FREEWAY EMERGENCIES (SAFE) MOTORIST AID PROJECTS PROJECT TITLE: AGENCY: NCFD RESCUE EQUIPMENT PROGRAM NATIONAL CITY FIRE DEPARTMENT drinking and driving on our freeways and to ensure that when a multi -casualty incident or hazardous materials incident does occur, the NCFD wishes to provide up-to-date life-saving rescue equipment to all of these accidents. One common deficiency among South Bay agencies is that while we have standard command practices for operating in an orderly manner during serious accidents that involve multiple victims or hazardous materials spills, none of these agencies have basic equipment to start an efficient mass casualty/motor vehicle/hazardous materials accident. The lack of simple equipment contained in these kits wastes time and causes disorganization that could be easily remedied with the use of these kits. The San Diego Service Authority for Freeway Emergencies (SAFE) will provide the necessary funding to purchase Hazardous Materials Response Kits and Rapid Response Kits for $15,000. 2. PERFORMANCE MEASURES: Goals 1. To quickly deliver life-saving personnel and rescue equipment to reduce the loss of life by staffing each NCFD fire engine with rescue equipment by December 2005. 2. To improve first responder services to multi -casualty incidents or hazardous materials incidents on freeways intersecting National City by obtaining up-to-date rescue equipment by December 2005. Objectives 1. To purchase and place rescue equipment in all NCFD apparatus by December 2005. 2. To train ail firefighters in the use of the rescue equipment by December 2005. 3. To improve the survival rate of vehicle accident victims by faster delivery of rescue equipment by December 2005. 3. PROPOSED SOLUTION: Almost every jurisdiction, including National City, deals with vehicle accidents caused by drunk drivers. National City's drunk driving issue is intensified by the substantial amount of drunk drivers returning from Mexico. Bringing a multi -casualty incident or hazardous materials incident to a successful and safe conclusion entails using state-of-the-art equipment and a trained rescue team as part of an operational plan that encompasses all the appropriate and necessary steps, procedures, and actions. Rescue personnel must use proper rescue equipment during these types of operations. They must be specially trained to handle these emergencies, and they must maintain tools and equipment so that they are ready whenever needed. In addition, the Standard Emergency Management System (SEMS) for multi -casualty incidents has been mandated for all first responders in the State of California. Equipment and material is required to be in place on all first responder units to assist in fulfilling that mandate. The Rapid Response Kit will help the NCH) meet these mandates. The Rapid Response Kit contains identifying tags for the patients involved, identifying flags, vests for command positions, and tarps so patients with varying degrees of injury can be separated. The Hazardous Materials Response Kit includes containment equipment to keep hazardous fluids from entering the environment through storm drains or decontamination equipment for affected motorists. These kits are portable enough to be carried on all first responder units in National City. With funding from the SAFE grant, the NCND will increase firefighter capabilities in various situations by providing a rapid response to multi -casualty incidents or hazardous materials incidents. Up- to-date rescue equipment is essential for the deployment of effective NCPD rescue teams and the successful rescue of vehicle accident victims. 2 Appendix "A" SAN DIEGO SERVICE AUTHORITY FOR FREEWAY EMERGENCIES (SAFE) MOTORIST AID PROJECTS PROJECT TITLE: AGENCY: NCFD RESCUE EQUIPMENT PROGRAM NATIONAL CITY FIRE DEPARTMENT 4. PROPOSED BUDGET: Rescue equipment to be purchased and placed into service for use at multi -casualty incidents or hazardous materials incidents include: Qty. WHY FUNDING IS NECESSARY: One major issue facing the City of National City is increased retirement benefits that were implemented 3 years ago resulting in a $4 million dollar budget shortfall. Due this problem the City of National City is limiting the NCFD's ability to purchase rescue equipment. As our department considers replacing aging equipment and adopting new technologies, the amount of funds needed for rescue equipment continues to grow out of reach. To make matters worse, requesting additional funds for rescue equipment has become increasingly difficult as we face budget shortfalls. 6. BENEFITS: Obtaining Hazardous Materials Response Kits and Rapid Response Kits are key to enhancing the NCFD's efforts to respond to multi -casualty incidents and hazardous materials incidents on our freeways. Use of the rescue equipment will allow NC1-'D firefighters to provide Life-saving equipment at vehicle accidents. This program's benefits of saving lives far outweigh the program costs. Any life saved through the use of this equipment will justify this program's costs. If awarded the Hazardous Materials Response Kits and Rapid Response Kits, the NCFD will do the following to promote it: • Display the Hazardous Materials Response Kits and Rapid Response Kits at the annual National City Fire Safety Fair. • Use the following standard language in all press releases: "Funding for this program was provided by a grant from the San Diego Service Authority for Freeway Emergencies (SAFE)." • E-mail or fax all press releases to SAFE. As you may know, a new fire station is currently under construction and the City has acquired a new fire engine. Both of these additions to the NCFD should become operational by April 2005. It is the hope of the NCFD to display both at our grand opening. Should you decide to grant the money to purchase the Hazardous Materials Response Kits and Rapid Response Kits, the NCFD will proudly display them at this major National City community event. 3 Appendix "A" RESOLUTION 2005 — 204 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND THE SAN DIEGO SERVICE AUTHORITY FOR FREEWAY EMERGENCIES FOR MOTORIST AID AND SAFETY PROJECT GRANT FUNDING, AND AUTHORIZING FUNDS IN THE AMOUNT OF $15,000 FOR THE REIMBURSABLE GRANT PURCHASE OF HAZARDOUS MATERIALS RESPONSE KITS AND RAPID RESPONSE KITS FOR THE FIRE DEPARTMENT WHEREAS, the Fire Department submitted a grant funding proposal to San Diego Service Authority for ("SAFE") Freeway Emergencies for a Fiscal Year 2005/2006 Motorist Aid and Safety Project Grant, and was awarded the grant; and WHEREAS, the grant funding will provide funding for actual costs for the purchase of Hazardous Materials Response Kits and Rapid Response Kits in a reimbursable amount not to exceed $15,000; and WHEREAS, the grant funds must be used to order and/or receive equipment prior reimbursement from the grant funds. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby authorizes the Mayor to execute an agreement between the City and San Diego Service Authority for Freeway Emergencies for Motorist Aid and Safety Project grant funding. Said Agreement is on file in the office of the City Clerk. BE IT ALSO RESOLVED, that the City Council hereby authorizes the utilization of $15,000 of City funds to purchase Hazardous Materials Response Kits and Rapid Response Kits for the Fire Department, and directs staff to request reimbursement for such expenditures from the San Diego Service Authority for Freeway Emergencies.
