HomeMy WebLinkAbout2006 CON Community Development Commission - Section 8 Computer MatchAMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY AND THE CITY OF NATIONAL CITY This Amendment to Agreement is entered into this 1st day of July, 2006, by and between the Community Development Commission of the City of National City, a municipal corporation ("CDC"), and the City of National City, a municipal corporation, ("City"). RECITALS A. The CDC and the City entered into an agreement on July 1, 2003, ("the MOU") wherein the City agreed to provide computer match inquiries for the Section 8 Rental Assistance Division. The parties desire to amend sections 2 (i) and 2 (iv) of the Memorandum of Understanding NOW, THEREFORE, the parties hereto agree that Sections 2 (i) and 2 (iv) of the Memorandum of Understanding dated July 1, 2003, be amended to read as follows: 2 (i). CDC agrees to pay up to $25,000 per year for 100 cases per month. If the caseload exceeds the average of 100 cases per month, each additional case will be billed to the CDC at a rate of $25.00 per case. 2 (iv) TERM OF AGREEMENT: This Agreement shall be extended to July 1, 2006 to June 30, 2009. The parties further agree that with the foregoing exception, each and every term and provision of the MOU dated July 1, 2003, shall remain in full force and effect. VIA: Tom McCabe, City Manager FROM: Paul Desrochers, Executive Director DATE: September 30, 1996 SUBJECT: MEMORANDUM OF UNDERSTANDING WITH POLICE DEPARTMENT FOR COMPUTER MATCH OF SECTION 8 APPLICANTS National City Police Department (NCPD), upon request, shall provide information to the Community Development Commission of the City of National City (CDC) regarding criminal conviction records of applicants and current participants for purposes of screening families applying for or currently participating in the Section 8 Rental Assistance Program. - NCPD agrees to do the following: 1. Provide computer search of Section 8 Rental Assistance applicants and current family participants each month for purposes of screening those applicants who have a past history of violent criminal activity or drug/alcohol abuse. 2. Search would be through ARGIS and if requested by CDC through CLETS and/or NCIC. Record search not to exceed last three (3) years. 3. Quantity would not exceed 100 individual records per month. 4. Information regarding applicants to be provided to CDC within 10 working days. Some. requests may require a quicker response. 5. Provide copies of arrest records as authorized by law, as needed as result of search. May include records from other police departments and may include the name and telephone number of a person's probation officer. 6. Pursuant to a CLETS and NCIC/FBI index criminal history check in the Automated System, NCPD will advise CDC whether or not there may be a criminal history file on the applicant/participant. NCPD will forward the fingerprints to the California Department of Justice and FBI for criminal history checks. Upon receipt of the criminal history checks, the NCPD will forward information to the CDC. CDC agrees to do the following: 1. CDC agrees to pay up to $50,000 per year for the above -stated services. 2. CDC will coordinate inquiries and will designate one staff person to be liaison with the NCPD: 3. CDC further agrees to establish and implement a system of records management ensuring that all criminal records received by the Housing Authority are maintained confidentially; and, the CDC shall not disclose or use the information for any purpose other than that authorized. The CDC is in the process of formalizing the Memorandum of Understanding with the City of National City. In February 1995, the Community Development Commission and the National Police Department entered into a verbal agreement wherein the Police Department would provide the housing authority with drug and criminal history information for the purpose of screening prospective applicants and current participants of the Section 8 Rental Assistance Program. This verbal agreement helped the housing authority in complying with HUDs "One Strike and You're Out" Screening and Eviction Guidelines for Public Housing Authorities (HAs). On September 30, 1996, A Memorandum of Understanding was entered into between the CDC and NCPD regarding a more formal request of the computer match inquiries from the housing authority. This MOU is subject to formal approval, and allowing the CDC the ability to properly screen prospective families during the eligibility and recertification process. The CDC and NCPD understand that the Section 8 unit will make all requests for computer matches as needed for the determination of initial or recertification eligibility. 1. NCPD Agrees to do the following: i. Provide computer search of Section 8 Rental Assistance applicants/participants will be provided each month for purposes of screening those applicants who have a past history of violent criminal activity or drug/alcohol abuse. ii. Search will be through ARJIS and, if requested by CDC, through CLETS and/or NCIC, Sheriff R101 File, DA Files and Warrants System. Record search not to exceed the last five (5) years. iii. Quantity would not exceed 100 individual records per month. iv. Information regarding applicants to be provided to CDC within 10 working days. Some requests may require a quicker response. v. Provide copies of arrest records as authorized by law, as needed as result of search. May include records from other police departments and may include the name and telephone number of a person's probation officer. vi.
