BETWEEN
THE CITY OF NATIONAL CITY
AND
MOYNAHAN TOWING FOR TOWING SERVICES
This Amendment to Agreement is madc and entered into this 15th day of May, 2007, by
and between the City of National City, hereinafter referred to as "CITY" and MOYNAHAN TOWING, a
California corporation, hereinafter referred to as "CONTRACTOR."
RECITALS
WHEREAS. CITY and CONTRACTOR entered into an agreement on March 21, 2006,
entitled "Agreement for Towing Services," wherein CONTRACTOR agreed to provide non-exclusive
towing services for CITY, effective April 1, 2006 to March 31, 2009.
NOW, THEREFORE, in consideration of the mutual benefit to he derived therefrom,
CITY and CONTRACTOR hereby agree to amend Section 5.1, by deleting the following language: "The
contractor on -call rotation shall run weekly, beginning at 0000 hours on Sunday, through the following
Saturday", and inserting the following language:
"The CONTRACTOR on -call rotation shall run from 0000 hours the first day of
each month through 2359 hours on the fifteenth of each month for the first
contractor, beginning May 1, 2007. The second contractor will then conduct city
tows from 0000 hours the sixteenth day of each month thereafter until 2359 hours on
the last day of the month. The tow contractors will alternate this schedule for the
duration of the Agreement."
Except as otherwise provided herein, all of the provisions of the Agreement for Towing Services
between the City of National City and Moynahan Towing dated March 21, 2006, shall remain in full force
and effect.

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
AUTHORIZING THE MAYOR TO EXECUTE AMENDMENTS
TO THE AGREEMENTS FOR TOWING SERVICES WITH
JC TOWING COMPANY AND WITH MOYNAHAN TOWING
WHEREAS, on March 21, 2006, the City entered into an Agreement for Towing
Services with JC Towing, and on the same date, entered into an Agreement for Towing
Services with Moynahan Towing; and
WHEREAS, the City, JC Towing, and Moynahan Towing desire to amend Section
5.1 of each Agreement for Towing Services, in order to establish a rotation schedule between
the two companies to occur every two weeks, instead of every week.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby authorizes the Mayor to execute Amendments to the respective
Agreements for Towing Services between the City, JC Towing, and Moynahan Towing, in order
to establish a rotation schedule between the two companies to occur every two weeks, instead
of every week. Said Amendments to Agreements are on file in the office of the City Clerk.

EXPLANATION
The towing companies signed a contract with the City for rotating tow services for the City. The
prior contract allowed for a rotation schedule between the two companies to occur every two weeks. The
current contract calls for rotation every week. The tow companies desire to rotate every two weeks, as
in the prior contract provisions. The City has no objections to this amendment to the towing schedule.
