RESOLUTION NO. 2007 — 70 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO AGREEMENT WITH THE COASTAL CONSERVANCY PERTAINING TO A GRANT FOR THE CONSTRUCTION OF PARADISE CREEK EDUCATION PARK WHEREAS, the City has entered into an Agreement with the California State Coastal Conservancy for the construction of Paradise Creek Education Park; and WHEREAS, it is necessary to amend the Agreement to extend the project completion date to June 30, 2007, and the term of the Agreement to June 30, 2027, to ensure that the project area remains dedicated park land for the duration of Agreement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby authorizes the Mayor to execute Amendment No. 2 to the Agreement with the California Coastal Conservancy, to extend the project completion date to June 30, 2007, and the term of the Agreement to June 30, 2027, pertaining to a grant for the construction of Paradise Creek Education Park. This amendment is standard to all Coastal Conservancy -funded projects. Community Services was the originating Department. Since then, the following has occurred: • On April 24th, 2007, the City Clerk's office sent a letter and a partially executed contract to the California State Coastal Conservancy requesting return of a fully executed agreement. • The City Clerk's office made numerous attempts to locate/track down and/or acquire a signed copy of the agreement. • Six months have passed since our letter to the Coastal Conservancy, with no results. It is our intention therefore to cease further efforts to acquire a signed agreement. We will, instead, insert in the file a copy of this memo and the attached 'note to file.'
