HomeMy WebLinkAbout2011 CON CDC Safdie Rabines - Amendment #1 National City Aquatic CenterFIRST AMENDMENT TO AGREEMENT BY AND BETWEEN COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY AND SAFDIE RABINES ARCHITECTS This Amendment to Agreement is made and entered into this 3rd day of August, 2011 by and between the COMMUNITY DEVELOPMENT COMMISSION OF NATIONAL CITY ("CDC"), and SAFDIE RABINES ARCHITECTS ("CONSULTANT"). WHEREAS, as the result of a competitive REQUEST FOR PROPOSALS process, on July 12, 2005 the CDC and CONSULTANT entered into an AGREEMENT (the "Agreement") to provide architectural services for the National City Aquatic Center; and WHEREAS, in order to facilitate timely completion of permitting following the issuance of 2011 Tax Allocation Bonds for the project in March, 2011, CDC and CONSULTANT entered a contract to continue work on said project on May 1, 2011; and WHEREAS, the scope and time of said contract expired on May 30, 2011; and WHEREAS, a major contract to complete permitting and construction of said project is anticipated to be presented to the CDC in September, 2011; and WHEREAS, schedule requirements related to completion of the Building Permit for the project preclude placing a hold on the architectural services; and WHEREAS, City Council/CDC Policy 502 provide that the City Manager/Executive Director may amend contracts under his or her sole signing authority by up to 25-percent of the original contract amount; and WHEREAS, 25-percent ofthc May 1, 2011 contract amounts to $12,036.50; and WHEREAS, the CDC desires to extend the scope to continue architectural services necessary to completing storm water planning and respond to corrections requested by the City's Building Official so that the Building Permit can be obtained timely as required; NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE TO AMEND TO SCOPE OF SERVICES OF TIIE AGREEMENT AS FOLLOWS: 1. To amend the AGREEMENT so deliverables identified in Exhibit A may be reconfigured or redefined as best suits the project and with the advanced approval of the Project Coordinator as long as the complete Scope agreed upon is completed; 2. To increase the not to exceed amount of the contract by $12,036.50 to a total of $60,182.50; 3. To extend the term of the AGREEMENT until September 30, 2011. With the foregoing exception, each and every provision of the AGREEMENT entered into on May 1, 2011 shall remain in full force and effect.
