San Diego Bay Watershed Urban Runoff Management Program
Annual Reporting
JULY 2011
This Cost Share Agreement, hereinafter called the "AGREEMENT" is made and entered into in
June 2011, between the County of San Diego, Cities of San Diego, Lemon Grove, La Mesa,
National City, Chula Vista, Imperial Beach, Coronado, the San Diego County Regional Airport
Authority, and the San Diego Unified Port District, a public corporation ("Port"), all of which shall
be referred to herein after as "PARTY/IES."
RECITALS
WHEREAS, the San Diego Regional Water Quality Control Board has determined that the
responsible PARTIES for the San Diego Bay Watershed Management Area, under NPDES
Municipal Permit Order No. R9-2007-0001 (NPDES Permit No. CAS0108758), are the County of
San Diego, Cities of San Diego, Lemon Grove, La Mesa, National City, Chula Vista, Imperial
Beach, Coronado, the San Diego County Regional Airport Authority, and the Port; and,
WHEREAS, the San Diego Bay Watershed Copermittees are required to cooperate in the
implementation of the Watershed Urban Runoff Management Plan (WURMP) program and the
development of a WURMP Annual Report pursuant to Califomia Regional Water Quality Control
Board, San Diego Region, NPDES Municipal Permit Order No. R9-2007-0001, Section E J.3.b.2;
and,
WHEREAS, the PARTIES recognize that expenditures will be needed to complete the Fiscal
Year 2010-11 San Diego Bay WURMP Annual Reporting requirements (Attachment A) at a cost
not to exceed $ 15,000. The cost will be shared among the PARTIES as indicated in Section
IV.A and Exhibit 1; and,
WHEREAS, the PARTIES have agreed upon the cost as described in Exhibit 1 and the scope
of work as indicated in Exhibit 2; and,
WHEREAS, the Port has agreed to lead the technical effort by providing project management
and contract administration services for the PARTIES and will hire a mutually agreed upon
consultant to perform the identified scope of work described in Exhibit 2 per the cost estimate
as described in Exhibit 1.
NOW, THEREFORE, the PARTIES incorporate the RECITALS set forth above and mutually
agree as follows:

I. PURPOSE: This AGREEMENT is entered into for the purpose of outlining the
responsibilities of the PARTIES and funding the annual reporting requirements as
described in Exhibit 1 and 2.
II. TERM: The term of this AGREEMENT commences on the date of the last signature of
the duly authorized representatives of the PARTIES and shall run until June 30, 2012.
III. PARTY RESPONSIBILITIES AND PARTICIPATION:
A. RESPONSIBILITIES OF CONTRACT REPORTING AND TECHNICAL LEAD:
The Port is hereby designated the Contract Reporting and Technical Lead. As
such, the Port incurs the responsibility of overall project management,
administration of consultant contracts, responsibility of coordinating overall
Annual Report products such as the cost share agreement, and submittal of
2010-2011 San Diego Bay WURMP Annual Report on behalf of the PARTIES as
required in the NPDES Municipal Permit Order No. R9-2007-0001, and other
administrative duties as agreed upon by the PARTIES.
B. RESPONSIBILITIES OF ALL PARTIES: Each PARTY agrees to be participatory
in the development and compilation of information pertaining to the San Diego
Bay WURMP Annual Report, and will assign one (1) person to serve as the
PARTY representative to participate in meetings, collaborate on developing
strategies, making decisions, submitting required information such as watershed
activity summary sheets, reviewing work products and draft documents, and
submittals, and providing input according to an agreed upon timeline.
C. RESPONSIBILITIES OF CONSULTANT SELECTION: The Port will be
responsible for the preparation of, advertising for, opening, reviewing bids, award
and administration of the consultant contract.
The PARTIES agree to participate in the selection of a single consultant to
perform the work identified in Exhibit 2. Participation will include, but not be
limited to, review of submitted proposals, interviews with consultants, and
determination of final consultant selection.
IV. FUNDING:
A. The cost of developing the San Diego Bay WURMP Annual Report for Fiscal Year
2010-11 per the scope of work described in Exhibit 2 will not exceed $15,000.
The costs are shared as shown in the table below and are based on a formula of
45% land area, 45% population, and 10% equal division fee for each PARTY
contributing to the San Diego Bay WURMP (Table 1):

B. Each PARTY shall pay its share of Annual Reporting costs within 60 days of
receipt of an invoice from the Contract Reporting and Technical Lead. An
invoice shall be sent to each PARTY no later than March 1, 2012.
V. NON-COMPLIANCE WITH AGREEMENT REQUIREMENTS: Any participant to this
AGREEMENT found to be in non-compliance with the conditions of this AGREEMENT
shall be solely liable for the portion of any lawfully assessed penalties resulting directly
from that participant's non-compliance. This provision shall not prohibit any participant
from seeking compensation or reimbursement from other participants who were found to
be in non-compliance with this AGREEMENT. Failure to comply with AGREEMENT
conditions within specified or agreed upon timelines shall constitute non-compliance with
the AGREEMENT.
VI. AMENDMENTS TO THE AGREEMENT: This AGREEMENT may be amended only by
consent of all the PARTIES. No amendment shall be effective unless it is in writing and
signed by the duly authorized representatives of the PARTIES.
VII. GOVERNING LAW: This AGREEMENT shall be governed and construed in
accordance with the laws of the State of California. If any provision or provisions shall
be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of
the remaining provisions shall not in any way be affected or impaired thereby. In
addition, each PARTY agrees to comply with all federal, state and local laws and
ordinances applicable to the work to be performed under the terms of this
AGREEMENT.
VIII. CONSENT AND BREACH NOT WAIVER: No term or provision hereof shall be deemed
waived and no breach excused, unless such waiver or consent shall be in writing and
signed by the PARTIES to have waived or consented. Any consent by any PARTY to,
or waiver of, a breach by the other, whether expressed or implied, shall not constitute a
consent to, waiver of, or excuse for any other different or subsequent breach.
IX. DISPUTES: The PARTIES agree to mediate any dispute prior to filing suit or
prosecuting suit against the other parties. In the event suit is brought upon this

AGREEMENT to enforce its terms, each PARTY shall be responsible for their own
attorneys' fees and costs.
X. LEGAL RESPONSIBILITY: Each PARTY to this AGREEMENT (1) shall retain its legal
responsibility to comply with the NPDES Municipal Permit Order No. R9-2007-0001, and
(2) shall pay all fines, penalties, and costs which may arise out of such PARTY's non-
compliance with Order No. R9-2007-0001.
XI. APPLICATION OF PRIOR AGREEMENTS: This AGREEMENT constitutes the entire
Agreement between the parties with respect to the subject matter; all prior agreements,
representations, statements, negotiations, and undertakings are superseded hereby.
XII. TERMINATION: Termination of participation from this AGREEMENT by any PARTY
shall require thirty (30) days written notice to all PARTIES prior to the effective date of
termination. Termination of this agreement does not release any PARTY for obligations
of Order No. R9-2007-0001, nor does it release the PARTY from their financial
responsibilities as outlined in Section IV of this AGREEMENT. Upon termination, the
terminating PARTY shall pay their cost share in full.

SCOPE OF WORK TO ASSIST WITH
SAN DIEGO BAY WURMP ANNUAL REPORTING
Exhibit 2
Pursuant to California Regional Water Quality Control Board, San Diego Region, NPDES Municipal
Permit Order No. R9-2007-0001 (NPDES Permit No. CAS0108758), Section E J.3.b.2,
Consultant agrees to perform consulting services to develop a WURMP Annual Report.
Consultant shall provide the necessary qualified personnel to adequately complete the services.
Consultant shall perform/provide the following:
FISCAL YEAR 2010-11 ANNUAL REPORT — This task consists of providing technical
information and consultation for the development of the San Diego Bay WURMP Annual
Report for the reporting period between July 1, 2010 through June 30, 2011. Individual
jurisdictions will develop watershed activity sheets for their respective activities and will provide
other required information. The Consultant will compile the information from the watershed
activity sheets, the San Diego County Municipal Copermittee Receiving Waters and Urban
Runoff Monitoring Report, and Total Daily Maximum Daily Loads (TMDL) BMP Implementation
Plan updates for the Chollas Creek Dissolved Metals and Diazinon TMDLs and Shelter Island
Yacht Basin Dissolved Copper TMDL, and the San Diego Region Beaches and Creeks
Indicator Bacteria TMDL. The Consultant will report the results in the appropriate sections of
the Annual Report. The Consultant will present the watershed information in a manner
agreed upon by the San Diego Bay WURMP Copermittees and appropriate to demonstrate
compliance with NPDES Municipal Permit Order No. R9-2007-0001 as discussed in
Attachment A. The Consultant shall also complete the following:
Task 1 WURMP Annual Report Project Management
• Project management will consist of preparing a project schedule and
coordinating submittals from the Copermittees to attain this schedule.
Consultant will coordinate the submittals of watershed activity sheets, TMDL
BMP Implementation Plan updates, water quality monitoring data, and other
pertinent data from San Diego Bay WURMP Copermittees;
Task 2 WURMP Annual Report Meetings
• The consultant or consultant's representative will attend monthly San Diego
Bay WURMP workgroup meetings during the development of the WURMP
Annual Report from August through January. The consultant is expected to
provide an update to the Lead Copermittee as to the progress of the
WURMP Annual Report prior to scheduled workgroup meetings. Up to two
additional meetings may be required to incorporate Copermittee comments
and finalize the report. This task includes preparing annual report related
materials for meetings.
Task 3 WURMP Annual Report Preparation
This task consists of preparing and submitting the WURMP Annual Report;
• Recommend approaches to further fine-tune the San Diego Bay WURMP

Annual Report utilizing the standard Annual Report format agreed upon by
the Regional WURMP workgroup (Attachment B);
• Draft the San Diego Bay WURMP Annual Report using compiled watershed
activity data, water quality monitoring data, and additional available
watershed information identified by the San Diego Bay WURMP
Copermittees;
• Provide electronic copies of the draft San Diego Bay WURMP annual
report for review to the San Diego Bay WURMP Copermittees prior to
WURMP workgroup meetings during October through December 2011
(at maximum 3 drafts may be required);
• Incorporate and track Copermittee comments;
• Provide electronic copies of the final draft of San Diego Bay WURMP
Annual Report by mid -December 2011;
Task 4 Complete San Diego Bay WURMP Annual Report
• Incorporate San Diego Bay WURMP Copermittee final comments and
format final San Diego Bay WURMP Annual Report by mid -January;
• Collect original, signed San Diego Bay WURMP Annual Report Certification
Statements from each Copermittee for inclusion in the final report.
• Copy and deliver up to three electronic copies of the San Diego Bay WURMP
Annual Report to the Lead Copermittee by January 25, 2012;
• Provide up to twelve electronic and twelve hard copies of the final San Diego
Bay WURMP Annual Report.
DELIVERABLES:
• Schedule for report preparation as referenced in Task 1;
• San Diego Bay WURMP Annual Report outline and timeline for submittal of
draft San Diego Bay WURMP annual report, draft text for annual report
and/or responsibilities assigned for watershed activity sheet submittals as
necessary;
• Provide San Diego Bay WURMP Annual Report -related materials for
WURMP meetings;
• Up to 3 drafts of San Diego Bay WURMP Annual Reports (electronic
versions only);
• Up to twelve electronic and twelve hard copies of the final San Diego Bay
WURMP Annual Report to be distributed to the San Diego Bay Copermittees
• Final San Diego Bay WURMP Annual Report by January 25, 2012.

Attachment A
The San Diego Bay Watershed Urban Runoff Management Program (WURMP) Annual Report
shall be a comprehensive documentation of all activities conducted by the watershed
Copermittees during the previous annual reporting period to meet all requirements of NPDES
Municipal Permit Order No. R9-2007-0001 (NPDES Permit No. CAS0108758), Section E J.3.b.2.
The San Diego Bay WURMP Annual Report shall, at a minimum, contain the following for each
reporting period:
(a) A comprehensive description of all activities conducted by the watershed Copermittees to
meet all requirements of section E of NPDES Municipal Permit Order No. R9-2007-0001.
(b) Any updates to the watershed map.
(c) An updated assessment and analysis of the watershed's current and past applicable water
quality data, reports, analyses, and other information, including identification of the watershed's
water quality problems and high priority water quality problem(s) during the reporting period.
The annual report shall clearly note if any trends and/or changes in the watershed's high priority
water quality problem(s) from the previous reporting period.
(d) Identification of the likely sources, pollutant discharges, and/or other factors causing the

Copermittee during the reporting period, including information on the activities' location(s), as
well as information exhibiting that the activities in active implementation phase reduced
discharged pollutant Toads, abated pollutant sources, or resulted in other quantifiable benefits to
discharge or receiving water quality, in relation to the watershed's high priority water quality
problem(s). The annual report shall clearly describe any changes to Watershed Water Quality
Activities implementation that have occurred since the previous reporting period, and provide
justification for the changes.

(h) Identification and description of the Watershed Education Activities implemented by each
Copermittee for the reporting period, including information exhibiting that the activities directly
targeted the sources and discharges of pollutants causing the watershed's high priority water
quality problems, and that activities in active implementation phase changed target audience
attitudes, knowledge, awareness, or behavior. The annual report shall clearly describe any
changes to Watershed Education Activities implementation that have occurred since the
previous reporting period, and provide justification for the changes.
(i) A description of the public participation mechanisms used during the reporting period and the
parties that were involved.
(j) A description of Copermittee collaboration efforts.
(k) A description of efforts implemented to encourage collaborative, watershedbased, land -use
planning.
(I) A description of all TMDL activities implemented (including BMP Implementation Plan or
equivalent plan activities) for each approved TMDL in the watershed. The description shall
include:
i. Any additional source identification information;
ii. The number, type, location, and other relevant information about BMP
implementation, including any expanded or better tailored BMPs necessary to meet the
WLAs;
iii. Updates in the BMP implementation prioritization and schedule;
iv. An assessment of the effectiveness of the BMP Implementation Plan, which meets
the requirements of section 1.4 NPDES Municipal Permit Order No. R9-2007-0001; and
v. A discussion of the progress to date in meeting the TMDL Numeric Targets and
WLAs, which incorporates the results of the effectiveness assessment, compliance
monitoring, and an evaluation of additional efforts needed to date.
(m) An assessment of the effectiveness of the WURMP, which meets the requirements of
section 1.2 of NPDES Municipal Permit Order No. R9-2007-0001. The effectiveness
assessment shall attempt to qualitatively or quantitatively exhibit the impact that implementation
of the Watershed Water Quality Activities and the Watershed Education Activities had on the
high priority water quality problem(s) within the watershed. This information shall document
changes in pollutant load discharges, urban runoff and discharge quality, and receiving water
quality, where applicable and feasible.

WATERSHED URBAN RUNOFF MANAGEMENT PROGRAM ANNUAL REPORTS
This document provides a proposed organization and general description of the Watershed
Urban Runoff Management Plan (WURMP) Annual Reports to submitted each year by the
Copermittees in accordance with sections E, H, 1.2 and 4, and J.3.b of NPDES Order No. R9-
2007-0001 (Permit). WURMP Annual Reports are due to the RWQCB on or before January 31,
2009, and every year thereafter. Some modifications to this standardized format may occur
prior to submittal of the first WURMP Annual Reports utilizing this updated format. The
Copermittees will consult with RWQCB staff prior to adopting any substantive revisions to that
proposed below.
EXECUTIVE SUMMARY
SIGNED WURMP ANNUAL REPORT CERTIFICATIONS
Each Watershed Permittee will provide a signed certification covering its responsibilities in the
WURMP Annual Report.

updated 5-year strategic plan included in this section is intended to supersede earlier versions
presented in the WURMP itself or in previous Annual Reports. All changes to the 5-year
strategic plan will be clearly described and justified.
4.0 EFFECTIVENESS ASSESSMENT
4.1 ASSESSMENT OF OVERALL WURMP EFFECTIVENESS
Since activity -specific effectiveness assessments will be described in individual Watershed
Activity Implementation Summary Sheets, this section will focus on assessing WURMP
effectiveness as a whole. Assessing overall WURMP effectiveness will include consideration of
the following:
• An assessment of Copermittee collaboration efforts during the reporting period
• An assessment of whether watershed activities are focused on the appropriate water quality
problems and sources or whether additional information is needed to reach such
conclusions

• A comprehensive assessment of the impact of all WURMP activities (considered
collectively) on the watershed's high priority problems, with a focus at the Hydrologic Area
level. This should include documenting changes in pollutant Toads, urban runoff and
discharge quality, and receiving water quality, where feasible.
• Measurable targeted outcomes and assessment measures will be used to facilitate
assessment whenever possible. Assessment Levels 1-6 will be applied to the watershed as
a whole, where applicable and feasible.
4.2 ASSESSMENT OF TMDL BMP IMPLEMENTATION PLAN EFFECTIVENESS [IF
APPLICABLE]
If applicable to the watershed, this section will assess the effectiveness of any relevant TMDL
BMP Implementation Plans as a whole. The assessment will also include a discussion of
progress to date in meeting TMDL Numeric Targets and WLAs.
Assessment of TMDL BMP Implementation Plans will utilize measurable targeted outcomes,
assessment measures, and assessment methods. It will utilize outcome levels 1-6, where
applicable and feasible. It will also utilize outcome levels 5 and 6 to qualitatively assess the
effectiveness of the TMDL BMP Implementation Plan or equivalent plan as a whole. These
assessments will attempt to exhibit the effects of the TMDL BMP Implementation Plan or
equivalent plan on the impairment that is targeted.
