August 1, 2012 —June 30, 2013 EXHIBIT "A" cnsi California Property Specialists, Inc SCOPE OF SERVICES FOR THE WESTSIDE AMORTIZATION The City's community outreach and planning efforts began with the selection of a planning consultant in February 2005 to begin preparation of a Specific Plan for the Westside area. After multiple community workshops to provide input on the Specific Plan, the City Council formally adopted an Amortization Ordinance that defines the process by which legal nonconforming uses are to be amortized out of the Westside Specific Plan area. Non -conforming uses must be discontinued after a period of time has been reached, which has allowed the business to recover their investment. The criteria and the process for ranking non -conforming uses were adopted by the City Council in May 2011 after coordination with the EPA, the Environmental Health Coalition and discussions at the Old Town Neighborhood Council event. In order to implement the amortization of non -conforming uses in the Westside Specific Plan area ("Amortization Process"), CPSI proposes to work closely with legal counsel to follow an Amortization Process that will meet the requirements of the Amortization Ordinance and the ranking of non- conforming uses ("Amortization Ranking") that has been prepared for the City. REPORT TO CITY COUNCIL During the 30-day review period for the release of the Amortization Ranking, comments from the public will be collected and where appropriate and as directed by City staff, CPSI will prepare responses for legal counsel review. After the 30-day review period, CPSI will assist staff in preparing any required City Council staff report for comments received during the public review period. APPRAISAL OF NON -CONFORMING USES The following tasks have been prepared for the appraisal of two to three non -conforming uses following the requirements of the Amortization Ordinance: • Provide an in-depth amortization analysis of select non -conforming uses from the highest ranked non -conforming uses based on the Amortization Ranking. • Work with City staff and legal counsel to review property profiles for the selected two to three non -conforming uses. • Develop a business valuation appraisal of the total cost of land and total cost of improvements to ascertain the investment made by the non -conforming uses. • Work with City staff to make a determination on the adaptability of the land and improvements to a currently permitted use. • Determine a cost estimate of moving and reestablishing the use elsewhere based on a relocation estimate and an appraisal for reestablishment of the business in a new location. • Work with legal counsel to determine whether the use is significantly non -conforming due to its incompatibility with land use patterns and densities of the surrounding neighborhood; the possible threat to public health, safety or welfare; and consideration of other relevant factors. • Assist legal counsel in soliciting input from the two or three non -conforming uses. • Work with City staff to meet and consult with property owners to prepare the amortization schedules. • Develop schedules for implementing amortization of two or three of the selected non- conforming uses from the Amortization Ranking. California Property Specialists, Inc PLANNING COMMISSION PUBLIC HEARING/CITY COUNCIL APPEAL The amortization schedules for the two or three non -conforming uses will be specific to each business and property. The following activities are anticipated for CPSI: • Prepare a Staff recommendation to the Planning Commission for the amortization schedules for two to three non -conforming uses. • Assist City staff in preparing the Planning Commission staff report. • Attend the public hearing where the Planning Commission will consider of the proposed amortization schedules. • AS REQUIRED — If the property owner appeals the decision of the Planning Commission to the City Council, CPSI will be available to answer questions. • Attend the public hearing for City Council consideration of the Planning Commission's recommendation and action to order termination by amortization of the two to three non- conforming uses. WORK PLAN/PROJECT APPROACH California Property Specialists, Inc.'s approach to any National City (City) project will be based on: our extensive knowledge of the southern California area; our key personnel's vast years of knowledge and experience; and an understanding of what it takes to get a relocation assignment from start to finish with successful results. CPSI understands early project planning, identifying project tasks and deliverables, implementation of a quality control system, exceptional project performance, and a sequential outline and understanding of the scope of work, are critical to project success. California Property Specialists, Inc. (CPSI) founders, Kent Jorgensen and Georgia Marquis have over 47 years combined experience in the right of way industry. From company formation, our corporate philosophy is to employ the industry's most experienced staff with an educational program unmatched in the industry. Our staff members are "well seasoned professionals" with an average of over 16 years experience. The firm's team is exceptionally knowledgeable concerning the requirements of 49 CFR, Part 24, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, including the recent changes effective February 2005. In addition, our staff is familiar with and has utilized the Uniform Appraisal Standards for Federal Land Acquisitions; California Code of Federal Regulations, Title 25; Housing and Community Development; and the Caltrans Manual. Additionally, CPSI has been approved by Caltrans to work on federally funded projects. CPSI is Pro -active Due to the fact that CPSI Project Managers each have over 20 years experience and each has seen all types of circumstances in regards to project assignments, they are very quick to make the necessary adjustments to meet project time -frames. Important steps in recognizing potential issues are the utilization of the following tools: Early Project Planning CPSI's direct approach consists of CPSI's Principals Kent Jorgensen, Michael Garcia and Georgia Marquis immediately getting actively involved in the project assignment. At the beginning of the project, our Project Management Team will meet with City staff early to determine the project California Property Specialists; Inc requirements and identify project objectives and reporting requirements. Each of these individuals will become very cognizant of the City's project goals and what it takes to achieve them. This begins at project planning and doesn't conclude until after project completion. Tasks and Deliverables Upon receiving the assignment, in preparation for an initial project kick-off meeting, CPSI will immediately begin identifying project tasks and deliverables, project goals and parameters, time -frame schedules, and factors of influence in order to develop a Project Management Plan. By taking this pro- active approach, the initial project kick-off between CPSI and the City will not simply be just a meeting, but a critical building block for project success. These early management steps are one of the reasons CPSI stands alone in their project success record. Kick -Off Meeting CPSI's management staff will meet with the City to review the requirements for the requested services. Emphasis will be placed on reviewing the project requirements, discussing assigned tasks and deliverables, developing project management procedures and identifying critical path and schedule milestones. During the meeting, we will also discuss the City requirements regarding day-to-day coordination with City staff, any other relevant consultants. CPSI Quality Control CPSI has a work ethic and a commitment to excellence that is translated to a high -quality work product and a tremendous client satisfaction. All work performed by CPSI will be performed in accordance with applicable rules and regulations, and in a high -quality and professional manner. As a checks -and - balance system, CPSI has adopted a Quality Control Program (QC Program). Under the direction of Broker and Quality Control Manager, Kent Jorgensen, all CPSI staff members will have a working knowledge of CPSI's Quality Control Plan. This knowledge is implemented into every action, calculation, payment, and record from project beginning to project end. To ensure that this quality is being met, periodic quality/accuracy checks are made by CPSI's Quality Control Manager. Any exceptions are discussed and promptly corrected. To maintain consistency on our projects, CPSI has implemented a uniform filing system. Our project management files and each case file are set up exactly the same way. As a result, no matter who is working on this case, or no matter who is reviewing this case, information can be easily located, updated, and retrieved. crnsi California Property Specialists, Inc RATES/SCHEDULE Project Leads, Michael Garcia/Kent Jorgensen $115.00 per hour Relocation Project Manager, Georgia Marquis $105.00 per hour Project Analyst, Clara Castaneda $95.00 per hour Project Assistant, Jackie Martinez $75.00 per hour All work performed will be charged in accordance with the above rate schedule and each invoice would detail the project and services provided.
