By signing this Change Order the Contractor confines that he/she is completely familiar with its terms and conditions and has fairly
negotiated its price, teens and conditions. If this Change Order is approved, Contractor will provide all of the equipment, materials and
labor necessary to provide a complete work as described above at that the price stated herein. Additionally, Contractor confirms that the
price is fair and complete and represents all costs associated with the work, including but not limited to all equipment, materials, labor,
supervision, overhead, fees, bonds, insurance, profit, etc. and that there will be no further compensation. All of the terms and conditions

Reason/Purpose for this Change Order.
Per the city's request to back charge Palm Eng. for additional Soils & Testing costs per contract.
The City of National City and Contractor agree to the following change to the original Contract:
During the course of construciton Palm Eng. called for numerous soils testing throughout the project, however
on certain occassions Palm Eng. either failed to have the area ready for testing or failed the testing and
required subsequent testing. There were 28 addtional hours charged by Ninyo & Moore at $77.00 per hr. The
work, dates and hours are as follows: Rework Time (21.5 hrs) 8/1/12 - 2 hrs, 8/3/12 - 2 hrs, 8/6/12 - 1 hr,
8/9/12 - 3 hrs, 8/28/12 - 2 hrs, 8/30/12 - 2 hrs, 9/26/12 - 2.5 hrs, 9/28/12 - 4 hrs, 10/9/12 - 3 hrs and Show
Up/Not Ready (6.5 hrs) 9/25/12 - 2 hrs, 10/11/12 - 2.5 hrs, 10/24/12 - 2 hrs.
