ACCEPTING THE WORK OF JUST CONSTRUCTION, INC., FOR
THE PARADISE VALLEY ROAD PEDESTRIAN AND DRAINAGE
ENHANCEMENTS PROJECT, APPROVING THE FINAL CONTRACT
AMOUNT OF $231,173.38, AUTHORIZING RELEASE OF RETENTION
IN THE AMOUNT OF $11,558.67, AND AUTHORIZING THE MAYOR
TO EXECUTE THE NOTICE OF COMPLETION FOR THE PROJECT
WHEREAS, the Engineering Department is satisfied of that all work required to
be performed by Just Construction, Inc., for the Paradise Valley Road Pedestrian and Drainage
Enhancements Project has been completed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the work performed Just Construction, Inc., for the Paradise Valley Road
Pedestrian and Drainage Enhancements Project is accepted, the total final contract amount of
$231,173.38 is approved, the Mayor is authorized to execute the Notice of Completion, and
payment for said work is ordered to be made in accordance with said contract, including release
of the retention in the amount of $11,558.67.

EXPLANATION
The Paradise Valley Road Pedestrian and Drainage Enhancements Project, CIP No.
15-03, included improvements and construction of new sidewalk, curb and gutter, storm
drain, and lighting along the west side of Paradise Valley Road between East 8th Street
and East Plaza Boulevard. This project will provide a safe route to school between Ira
Harbison Elementary School and the residential feeder neighborhoods to the northeast.
On June 25, 2015, the bid solicitation was posted on PlanetBids, a free public electronic
bidding system for contractors. On June 26, 2015, the bid solicitation was advertised in
local newspapers.
On July 21, 2015, five (5) bids were received electronically on PlanetBids by the
2:00 p.m. deadline. Bid results were available immediately after the 2:00 p.m. deadline.
Just Construction, Inc. was the apparent low bidder with a total bid amount of
$201,000.00. Upon review of all documents submitted and reference checks, Just
Construction, Inc.'s bid was responsive, and they were the lowest responsible bidder
qualified to perform the work as described in the project specifications.
On August 18, 2105, the City Council adopted Resolution No. 2015-121 awarding the
contract to Just Construction, Inc. in the amount of $201,000 and authorized a 15%
contingency in the amount of $30,150.00 for any unforeseen changes.
The Notice to Proceed with construction was issued on October 14, 2015, with a
construction start date of October 26, 2015.
The change orders issued for this project are detailed in the Final Contract Balance
Report (see attached). The change orders increased the contract by $30,010.08, while
line item adjustments increased the contract by $163.30, for a net increase of
$30,173.38 to the contract. This results in a 15% contract increase for a final contract
balance of $231,173.38.
As a result of satisfactory completion of the project, staff recommends that City Council:
1) accept the work of Just Construction, Inc. for the Paradise Valley Road Pedestrian
and Drainage Enhancements, CIP No. 15-03, 2) approve the final contract amount of
$231,173.38, 3) authorize the release of retention in the amount of $11,558.67, and 4)
authorize the Mayor to sign the Notice of Completion for the project.
The Notice of Completion will be filed with the San Diego County Recorder's Office.

The Final Contract Balance reports final line item amounts and summarizes all change orders to produce
a final contract amount.
CHANGE ORDERS AND LINE ITEM ADJUSTMENTS:
Change Order #1 directed the contractor to remove and replace approximately 100' of existing failed
sidewalk and grade the adjacent slope along the west side of Paradise Valley Rd., between 8t' St. and
Paradise Ave. This included clearing existing vegetation between the sidewalk and drainage channel,
removing existing silty soil, preparing a bench as needed, over -excavating and compacting the slope,
importing material as needed, grading the sidewalk, repairing the adjacent chain Zink fence as needed,
and reconstructing the sidewalk. This work was performed at an agreed upon price to include all labor,
equipment and materials. This Change Order total amount was $ 24,259.25.
Change Order #2 directed the contractor to install an additional pull box for the meter pedestal and
conduit intercept near the northwest corner of Paradise Valley Rd. and E. Plaza Blvd. This work was
performed at an agreed upon price. This Change Order total amount was $ 452.55.
Change Order #3 directed the contractor to install approximately 21' of additional chain link fence at the
wing walls adjacent to the project's headwall fence, but not identified on plans. The work was
performed at an agreed upon price. This Change Order total amount was $ 800.00.

FINAL CONTRACT BALANCE
National City Paradise Valley Road Pedestrian and Drainage Enhancements
Specification No. 15-03
Change Order #4 directed the contractor to re-route the City sidewalk around an existing City of San
Diego vault. The value of the sidewalk was paid at the contract unit price. This Change Order includes
all additional labor costs and re -mobilization the contractor incurred not performing this work with the
contract sidewalk work. This Change Order total amount was $ 1,463.00.
Changer Order #5 directed the contractor to hydro -seed approximately 30,000 sf of disturbed areas
behind the new city sidewalk, slope repair and miscellaneous areas disturbed during construction. The
contractor also is responsible for hydro -seeding at his expense an additional 15,000 sf of area disturbed
during his grading operation on the site. This work was performed at an agreed upon price. This
Change Order total amount was $ 2,738.15.
Change Order #6 reimburses the contractor his Bond Cost, per contract specifications. This Change
Order total amount was $ 297.00.
All Change Orders listed above increased the total contract amount $ 30,010.08.
There were numerous line item adjustments per the attached FINAL BILLING STATEMENT that resulted
in a total increase of $ 163.30.
CONTRACT ADJUSTMENT:
As a result of the above change orders and line item adjustments, the contract price is adjusted as
follows:
1. The final contract price is adjusted to $ 231,173.38.
2. As a result of the satisfactory completion of said project, a retention amount of $ 11,558.67 is
set for invoice processing and payment upon the receipt of signatures and City Council's
ratification of this agreement and the Notice of Completion.
This document and its purpose to balance payment shall be considered full compensation for furnishing
and installing the materials, labor, tools and equipment, profit, overhead, and all incidentals for
performing the work described above. Just Construction, Inc. will not be entitled to damages or
additional payment for delays as described in the 2012 edition of the Standard Specifications for Public
Works Construction, Section 6-6.3, for performing the work as described above.
