THIS FIRST AMENDMENT TO THE AGREEMENT, is entered into this 24th day of August, 2017, by and between the CITY OF NATIONAL CITY, a municipal corporation ("CITY"), and VORTEX INDUSTRIES, INC., a California corporation (the "CONTRACTOR"). RECITALS WHEREAS, on July 1, 2017, the CITY entering into an Agreement with CONTRACTOR wherein the CONTRACTOR agreed to provide on -site service, repairs, and maintenance to roll - up doors and gates as -needed and as directed by CITY'S Facilities Maintenance Supervisor, Arturo Gonzalez. WHEREAS, the original Agreement had a not -to -exceed amount of $10,000 and an expiration date of June 30, 2018. WHEREAS, the parties desire to amend the Agreement to increase the scope of work to include replacement of the red, galvanized steel flat slat roll -up doors on the north side of the National City Police Department for the not -to -exceed amount of $21,256.40, as set forth in the attached Exhibit "A". NOW, THEREFORE, the parties hereto agree that the Agreement entered into on July 1, 2017 shall be amended as follows: 1. The Scope of Work shall be increased to include replacement of the red, galvanized steel flat slat roll -up doors on the north side of the National City Police Department for the not -to -exceed amount of $21,256.40, as set forth in the attached Exhibit "A". The total not -to -exceed amount of the Agreement is increased to $31,256.40 2. The parties further agree that, with the foregoing exception, each and every term and provision of the Agreement dated July 1, 2017, shall remain in full force and effect.
