HomeMy WebLinkAbout2021 CON City of Chula Vista - Animal Shelter ServicesFIRST AMENDMENT to the Agreement between the • City of Chula Vista and City of National City Providing Animal Shelter Services J This FIRST AMENDMENT ("Amendment") is entered into effective as of July 1, 2021 ("Effective Date") by and between the City of Chula Vista ("City") and City of National City ("National City"), (collectively, "the Parties") with reference to the following facts: RECITALS WHEREAS, in 2020 the Parties entered into the Agreement between the City of Chula Vista and the City of National City Providing Animal Shelter Services ("Original Agreement"), with a term of July 1, 2020 to June 30, 2021; and WHEREAS, in this Amendment, the Parties desire to eliminate from the Original Agreement Section 3.1.C, Licensing, as an Excluded Service, because City routinely offers licensing, when applicable, when a stray animal is claimed; and WHEREAS, the Original Agreement expires on June 30, 2021, and the Parties desire to continue their relationship. - NOW, THEREFORE, in consideration of the above recitals and the mutual obligations of the Parties set forth herein, the Parties agree as follows: 1. Section 3.1.C, Licensing, is eliminated from the Original Agreement, as an Excluded Service. 2. Pursuant to Section 1.1.A of the Original Agreement, which provides -for three (3) one- year options to extend, the Parties agree to exercise the first option to extend, for a term of July 1, 2021 to June 30, 2022. 3. Except as expressly provided herein, all other terms and conditions of the Original Agreement shall remain in full force and effect. 3. Each party represents that it has full right, power and authority to execute this First Amendment and to perform its obligations hereunder, without the need for any further • action under its governing instruments, and the parties executing this Amendment on the behalf of such party are duly authorized agents with authority to do so. We accept the proposal outlined in your letter dated February 18, 2021 in which the City of Chula Vista will continue to provide Animal Care Services for the City of National City for FY 21/22 at a contract price of $412,612, or $34,384 monthly. For calendar year 2020, the Chula Vista Animal Care Facility took in 3,306 animals. Of these, 518 (15.67%) were from the City of National City. The contract calculations utilize a three-year average utilization to benefit both parties. The percentage for the City of National City for the previous two years were 15.45% and 20.35% respectively. The three-year average is 17.16%. The contract also caps increases/decreases at 5% from the prior year. Therefore, the FY22 proposed calculation is 5% less than the FY21 contract amount. The City of Chula Vista is proposing to provide animal care services to the City of National City for FY 21/22 at a contract price of $412,612, or $34,384 monthly, National City residents also benefit from services we provide through grants and donations. Usually between 15-20% of our low cost Spay/Neuter appointments and 13- 16% of free microchip/rabies appointments are from National City residents. This past year during COVID we operated a pet pantry delivery service for people in need. 52% of people were from NC, representing 61 % of the pets served.
