THIS THIRD AMENDMENT TO THE AGREEMENT is entered into by and

RECITALS
WHEREAS, the CITY and the CONTRACTOR entered into an Agreement on February

Maintenance staff with ongoing tree

$90,000, and an initial term of two (2) years, with the option to extend this
term for up to two(2), one yearextensions; and,
WHEREAS, the City Council adopted Resolution No. 2020-172 approvingthe
to the Agreement extending First Amendment
g the length of the agreement from January 7, 2022 to June 30, 2022,
increasing the not -to -exceed amount to $90,000. per Fiscal Year, and authorizing ng the City Manager to
approve a one year extension of this Agreement for up to two (2) one-year CITY Fiscal Year extensions;
and,
WHEREAS, EAS, pursuant to authority delegated to him in the First Amendment,
the City Manager
approved the Second Amendment to the Agreement exercisingthe first one-year extension
extend the length of the agreementtens�oa option to
g from July I , 2022 to June 30, 2023 and increasing the not -to -exceed
amount to $90,000 per Fiscal Year; and,
WHEREAS, the parties desire to amend the Agreement byexercisingthe second cord of the two (2)
one-year extensions to extend the term of the Agreement to June 30, 2024; and
WHEREAS, the parties desire to amend the Agreement to increase the not -to -exceed need amount by
$90,000 for Fiscal Year 2024, beginning July 1, 2023, based on the high demand and, continuous need
for specialized tree trimming, removal, and planting services.
AGREEMENT
NOW, THEREFORE, E, the parties hereto agree that:
1. The Agreement entered into on February 18, 2020, is herebyamended to

2. The February 18, 2020 Agreement is hereby amended to increase the not -to -
exceed amount by
$90,000for Fiscal Year 2024, beginning July 1, 2023,based on the high demand and continuous need
for specialized tree trimming, removal, and planting services.
3. The parties further agree that, with the foregoing exceptions,each and
provision of the every other term and
